Verbraucherstreitbeilegung
Wir sind nicht verpflichtet und nicht bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
Geltungsbereich, Vertragspartner
(1) Diese Allgemeinen Geschäftsbedingungen gelten für alle Verträge über die Überlassung des Ferienhauses „Nordwindoase“, Mojenhörn 13, 21720 Grünendeich, zu Ferienzwecken.
(2) Vermieter sind Christian Renneberg und Tina Renneberg-Burmeister, Hinter der Mühle 33b, 21635 Jork (nachfolgend „Vermieter“).
(3) Der Vertrag ist ein Mietvertrag über Wohnraum zum vorübergehenden Gebrauch (§ 549 Abs. 2 Nr. 1 BGB). Reisevertragsrecht findet keine Anwendung, sofern keine weiteren Reiseleistungen geschuldet sind.
(4) Abweichende Bedingungen des Mieters werden nicht Vertragsbestandteil, es sei denn, der Vermieter stimmt ihrer Geltung ausdrücklich in Textform zu.
(5) Die Hausordnung ist Bestandteil dieses Vertrages. Sie wird dem Mieter vor Abgabe seiner Buchungsanfrage auf der Website zugänglich gemacht und mit der Buchungsbestätigung erneut übersandt.
Vertragsschluss
(1) Die Darstellung des Ferienhauses auf der Website und in Buchungsportalen stellt kein bindendes Angebot dar.
(2) Mit Absenden der Buchungsanfrage gibt der Mieter ein verbindliches Angebot auf Abschluss eines Mietvertrages ab.
(3) Der Vertrag kommt zustande, wenn der Vermieter die Buchung in Textform (E-Mail genügt) bestätigt. Maßgeblich für alle Fristen dieser AGB ist ausschließlich das Datum dieser Buchungsbestätigung.
(4) Der Mieter ist auch für die vertraglichen Verpflichtungen seiner Mitreisenden verantwortlich, sofern er diese Verpflichtung durch ausdrückliche und gesonderte Erklärung übernommen hat.
Preise und Nebenkosten
(1) Der in der Buchungsbestätigung ausgewiesene Gesamtpreis ist ein Endpreis. Er enthält sämtliche verpflichtenden Nebenkosten (u. a. Endreinigung, Bettwäsche, Strom, Wasser, Heizung), die Touristikabgabe der Gemeinde Lühe sowie die jeweils gültige gesetzliche Umsatzsteuer. Es fallen keine weiteren obligatorischen Kosten an.
(2) Die Touristikabgabe der Gemeinde Lühe ist im Gesamtpreis enthalten und wird vom Vermieter abgeführt. Eine gesonderte Zahlung vor Ort ist nicht erforderlich.
(3) Optionale Zusatzleistungen werden nur berechnet, wenn sie ausdrücklich gebucht wurden.
Zahlung
(1) Innerhalb von sieben Tagen nach Erhalt der Buchungsbestätigung ist eine Anzahlung in Höhe von 20 % des Gesamtpreises fällig.
(2) Der Restbetrag ist spätestens 30 Tage vor dem Anreisetag ohne gesonderte Aufforderung fällig. Bei Buchungen weniger als 30 Tage vor Anreise ist der Gesamtpreis sofort in voller Höhe fällig.
(3) Gerät der Mieter mit einer Zahlung in Verzug, kann der Vermieter ihm eine angemessene Nachfrist setzen und nach deren fruchtlosem Ablauf vom Vertrag zurücktreten. In diesem Fall stehen dem Vermieter die Ansprüche nach § 9 dieser AGB zu.
An- und Abreise
(1) Die Ferienwohnung steht am Anreisetag ab 14:00 Uhr zur Verfügung und ist am Abreisetag bis spätestens 11:00 Uhr geräumt zu übergeben. Abweichende Zeiten können in Textform vereinbart werden.
(2) Überschreitet der Mieter die Abreisezeit um mehr als eine Stunde, ohne dass dies vereinbart wurde, kann der Vermieter für die dadurch entstehende Nutzungsausfall- und Reinigungsverzögerung einen pauschalierten Schadensersatz in Höhe des Tagesmietpreises verlangen. Dem Mieter bleibt der Nachweis vorbehalten, dass ein Schaden überhaupt nicht entstanden oder wesentlich niedriger ist als die Pauschale.
(3) Reist der Mieter nicht bis 23:59 Uhr des Anreisetages an und teilt er dem Vermieter auch keine spätere Anreise mit, kann der Vermieter die Wohnung nach Ablauf von 24 Stunden anderweitig vergeben. Die Zahlungspflicht des Mieters bestimmt sich in diesem Fall nach § 9.
(4) Bei verspäteter Anreise oder vorzeitiger Abreise besteht kein Anspruch auf anteilige Rückzahlung, soweit dem Vermieter keine Aufwendungen erspart bleiben und eine anderweitige Vermietung nicht möglich ist.
Belegung und Nutzung
(1) Die Ferienwohnung darf höchstens mit sieben (7) Personen belegt werden. Kinder und Säuglinge zählen als Personen. Die im Buchungsvorgang angegebene Personenzahl ist verbindlich. Eine Überbelegung berechtigt den Vermieter zur fristlosen Kündigung nach § 10 sowie zur Berechnung des durch die Mehrbelegung entstandenen Mehraufwands.
(2) Eine Untervermietung oder unentgeltliche Überlassung an Dritte ist nicht gestattet.
(3) Veranstaltungen, Feiern und Partys sind nicht gestattet. Die gesetzlichen Ruhezeiten sind einzuhalten.
(4) Besuch von Tagesgästen ist in angemessenem Umfang zulässig, muss dem Vermieter aber vorher angezeigt werden. Eine Übernachtung von Besuchern ist nicht gestattet.
Rauch- und Haustierverbot
(1) Das Rauchen ist in sämtlichen Innenräumen untersagt.
(2) Haustiere jeglicher Art dürfen nicht mitgebracht werden.
(3) Bei einem Verstoß gegen Absatz 1 oder 2 kann der Vermieter für die erforderliche Sonderreinigung und Geruchs- bzw. Allergenbeseitigung einen pauschalierten Schadensersatz in Höhe von 300 € verlangen. Dem Mieter bleibt der Nachweis vorbehalten, dass ein Schaden überhaupt nicht entstanden oder wesentlich niedriger ist als die Pauschale.
(4) Die Pauschale nach Absatz 3 dient der vereinfachten Abwicklung. Der Vermieter ist berechtigt, statt der Pauschale den konkret entstandenen Schaden geltend zu machen. Wird die Pauschale nicht ausgeglichen oder macht der Mieter von seinem Nachweisrecht nach Absatz 3 Gebrauch, rechnet der Vermieter konkret ab. In diesem Fall beauftragt der Vermieter ein Fachunternehmen mit der erforderlichen professionellen Geruchsneutralisation (Ozonbehandlung) sowie der Entfernung von Nikotin- und Teerrückständen an Wänden, Decken, Textilien, Polstermöbeln und Vorhängen und stellt dem Mieter die hierfür tatsächlich angefallenen, nachgewiesenen Kosten in Rechnung. Bereits geleistete Zahlungen auf die Pauschale werden angerechnet.
(5) Der Vermieter dokumentiert einen Verstoß nachvollziehbar (insbesondere durch Lichtbilder und die Bestätigung des beauftragten Reinigungsunternehmens) und stellt dem Mieter die Nachweise auf Verlangen zur Verfügung.
Pflichten des Mieters, Haftung des Mieters für Schäden
(1) Der Mieter verpflichtet sich, die Ferienwohnung, das Inventar, das Gebäude und die Außenanlagen pfleglich und schonend zu behandeln.
(2) Der Mieter haftet nach den gesetzlichen Vorschriften für alle Schäden an der Ferienwohnung, dem Inventar, dem Gebäude und den Außenanlagen, die er selbst oder Personen, die sich mit seinem Willen oder auf seine Veranlassung dort aufhalten – insbesondere Mitreisende, Besucher und von ihm beauftragte Dritte – schuldhaft verursachen. Für das Verschulden dieser Personen hat der Mieter wie für eigenes Verschulden einzustehen (§ 278 BGB).
(3) Steht fest, dass die Schadensursache aus dem Obhuts- und Verantwortungsbereich des Mieters stammt, obliegt es dem Mieter darzulegen und erforderlichenfalls zu beweisen, dass ihn kein Verschulden trifft. Im Übrigen bleibt die gesetzliche Beweislastverteilung unberührt.
(4) Für Verschlechterungen, die durch den vertragsgemäßen Gebrauch entstehen (normale Abnutzung), haftet der Mieter nicht (§ 538 BGB).
(5) Anzeigepflicht: Schäden und Mängel, die bei Ankunft bereits vorhanden sind, sind dem Vermieter unverzüglich, spätestens jedoch innerhalb von 24 Stunden nach Bezug anzuzeigen. Während des Aufenthalts auftretende Schäden sind unverzüglich anzuzeigen. Unterlässt der Mieter die Anzeige schuldhaft, haftet er für den daraus entstehenden Folgeschaden.
(6) Schlüssel: Bei Verlust eines Schlüssels oder Zugangsmediums haftet der Mieter für die tatsächlich erforderlichen Kosten des Ersatzes einschließlich eines etwaigen Austauschs der Schließanlage, sofern der Verlust von ihm zu vertreten ist.
(7) Versicherungsempfehlung: Wir empfehlen dringend den Abschluss bzw. die Überprüfung einer Privathaftpflichtversicherung mit Einschluss von Mietsachschäden sowie einer Reiserücktrittskostenversicherung.
(8) Abreise: Am Abreisetag sind persönliche Gegenstände zu entfernen, der Hausmüll ist in die vorgesehenen Behälter zu entsorgen, Geschirr ist gereinigt einzuräumen und die Spülmaschine auszuräumen. Kommt der Mieter dem nicht nach, kann der Vermieter den erforderlichen Mehraufwand für die Reinigung und Entsorgung in Rechnung stellen.
Kaution
(1) Der Vermieter kann eine Kaution in Höhe von 500 € verlangen. Die Zahlungsweise – Überweisung bis spätestens sieben Tage vor Anreise oder Hinterlegung in bar bei Anreise – gibt der Vermieter in der Buchungsbestätigung an.
(2) Die Kaution wird innerhalb von 14 Tagen nach Abreise zurückgezahlt, soweit sie nicht zur Deckung berechtigter Ansprüche des Vermieters aus diesem Vertrag benötigt wird. Eine Einbehaltung ist dem Mieter unter Angabe der Gründe in Textform mitzuteilen.
(3) Die Kaution begrenzt die Haftung des Mieters nach § 8 nicht.
Rücktritt durch den Mieter (Stornierung)
(1) Der Mieter kann jederzeit vor Mietbeginn vom Vertrag zurücktreten. Der Rücktritt bedarf der Textform. Maßgeblich ist der Zugang der Rücktrittserklärung beim Vermieter.
(2) Bei Rücktritt kann der Vermieter eine angemessene Entschädigung für die getroffenen Vorkehrungen und seine Aufwendungen verlangen. Diese Entschädigung wird wie folgt pauschaliert, jeweils bezogen auf den Gesamtpreis:

(3) Dem Mieter bleibt in jedem Fall der Nachweis vorbehalten, dass dem Vermieter kein oder ein wesentlich geringerer Schaden entstanden ist als die jeweilige Pauschale.
(4) Gelingt es dem Vermieter, das Objekt für den betroffenen Zeitraum anderweitig zu vermieten, wird der hierfür erzielte Mietzins abzüglich der Vermittlungskosten auf die Entschädigung angerechnet. Der Vermieter ist zu zumutbaren Bemühungen um eine anderweitige Vermietung verpflichtet.
(5) Der Mieter kann bis zum Mietbeginn verlangen, dass an seiner Stelle ein Dritter in den Vertrag eintritt. Die Mitteilung bedarf der Textform. Der Vermieter kann dem Eintritt widersprechen, wenn der Dritte den vertraglichen Anforderungen nicht genügt. Tritt ein Dritter ein, haften er und der Mieter gesamtschuldnerisch für den Mietpreis und die durch den Eintritt entstehenden Mehrkosten.
(6) Überzahlte Beträge werden unverzüglich zurückerstattet.
Rücktritt und Kündigung durch den Vermieter
(1) Der Vermieter kann vor Mietbeginn vom Vertrag zurücktreten oder den Vertrag während der Mietzeit fristlos kündigen, wenn
a) der Mieter trotz Mahnung und angemessener Nachfrist mit einer Zahlung in Verzug ist,
b) die Ferienwohnung erheblich über die vereinbarte Personenzahl hinaus belegt wird,
c) der Mieter oder seine Mitreisenden trotz Abmahnung nachhaltig gegen die Hausordnung, das Rauch- oder Haustierverbot oder die Ruhezeiten verstoßen,
d) die Ferienwohnung durch ein unvorhersehbares Ereignis (z. B. Wasserschaden, Brand, behördliche Anordnung) unbenutzbar wird.
(2) Im Fall des Absatzes 1 lit. d erstattet der Vermieter bereits gezahlte Beträge anteilig zurück. Der Vermieter bemüht sich um ein gleichwertiges Ersatzobjekt, schuldet ein solches jedoch nicht. Weitergehende Ansprüche des Mieters sind ausgeschlossen, soweit § 12 nichts anderes bestimmt.
(3) Im Fall des Absatzes 1 lit. a bis c behält der Vermieter den Anspruch auf den Mietpreis; ersparte Aufwendungen und Erträge aus anderweitiger Vermietung werden angerechnet.
Mängel, Abhilfe, Obliegenheiten des Mieters
(1) Der Mieter hat auftretende Mängel unverzüglich anzuzeigen und dem Vermieter eine angemessene Frist zur Abhilfe einzuräumen.
(2) Der Mieter ist im Rahmen des Zumutbaren verpflichtet, zur Behebung einer Störung beizutragen und einen entstehenden Schaden gering zu halten (Schadensminderungspflicht, § 254 BGB).
(3) Unterlässt der Mieter die Anzeige schuldhaft, so tritt eine Minderung nicht ein, soweit der Vermieter infolge der Unterlassung nicht Abhilfe schaffen konnte (§ 536c Abs. 2 BGB). Die gesetzlichen Gewährleistungsrechte des Mieters bleiben im Übrigen unberührt.
Haftung des Vermieters
(1) Der Vermieter haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer vorsätzlichen oder fahrlässigen Pflichtverletzung des Vermieters, seiner gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen, sowie für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung beruhen.
(2) Bei leicht fahrlässiger Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht) ist die Haftung auf den bei Vertragsschluss vorhersehbaren, vertragstypischen Schaden begrenzt. Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Mieter regelmäßig vertrauen darf.
(3) Im Übrigen ist die Haftung des Vermieters für leichte Fahrlässigkeit ausgeschlossen.
(4) Die verschuldensunabhängige Haftung des Vermieters für bei Vertragsschluss vorhandene Mängel nach § 536a Abs. 1 Alt. 1 BGB wird ausgeschlossen.
(5) Der Vermieter haftet nicht für vom Mieter eingebrachte Gegenstände und Wertsachen, soweit ihm nicht Vorsatz oder Fahrlässigkeit zur Last fällt. Es handelt sich um ein Ferienhaus ohne Beherbergungsleistungen; eine Haftung als Gastwirt nach §§ 701 ff. BGB besteht nicht.
(6) Der Vermieter haftet nicht für höhere Gewalt, landesübliche Strom- und Wasserausfälle, Unwetter, behördliche Anordnungen sowie für Beeinträchtigungen durch unvorhersehbare Baustellen oder natur- und ortsbedingte Gegebenheiten in der Umgebung. Der Vermieter ist bei der Behebung im Rahmen des Möglichen behilflich.
(7) An- und Abreise erfolgen in eigener Verantwortung des Mieters.
(8) Die vorstehenden Haftungsbeschränkungen gelten auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen des Vermieters. Ansprüche nach dem Produkthaftungsgesetz bleiben unberührt.
Kein Widerrufsrecht
Bei Verträgen über die Überlassung von Unterkünften zu anderen Zwecken als zu Wohnzwecken zu einem bestimmten Termin oder Zeitraum besteht nach § 312g Abs. 2 Nr. 9 BGB kein gesetzliches Widerrufsrecht. Es gelten die Stornierungsbedingungen nach § 9 dieser AGB.
Datenschutz
Die Verarbeitung personenbezogener Daten erfolgt ausschließlich nach Maßgabe der DSGVO und der Datenschutzerklärung. Eine Einwilligung des Mieters in die zur Vertragsdurchführung erforderliche Datenverarbeitung ist nicht erforderlich; Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO.
Schlussbestimmungen
(1) Die Hausordnung, die Objektbeschreibung und die Buchungsbestätigung sind Bestandteil des Vertrages.
(2) Fotos und Texte auf der Website dienen der realistischen Beschreibung. Der Vermieter behält sich Änderungen der Ausstattung vor, soweit diese gleichwertig sind und den Vertragszweck nicht beeinträchtigen.
(3) Es gilt das Recht der Bundesrepublik Deutschland.
(4) Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. An die Stelle der unwirksamen Bestimmung treten die gesetzlichen Vorschriften.
(5) Änderungen und Ergänzungen dieses Vertrages sowie Sonderwünsche und Nebenabreden bedürfen der Textform.
(6) Vertragssprache ist Deutsch. Diese Bedingungen werden in deutscher Sprache abgefasst; Übersetzungen dienen allein der besseren Verständlichkeit. Bei inhaltlichen Abweichungen ist die deutsche Fassung maßgeblich, soweit dem keine zwingenden Verbraucherschutzvorschriften entgegenstehen.

Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Scope, contracting parties
(1) These general terms and conditions apply to all contracts for the holiday letting of the house “Nordwindoase”, Mojenhörn 13, 21720 Grünendeich.
(2) The landlords are Christian Renneberg and Tina Renneberg-Burmeister, Hinter der Mühle 33b, 21635 Jork (hereinafter “the Landlord”).
(3) The contract is a lease of residential space for temporary use (§ 549 (2) no. 1 BGB). German package travel law does not apply unless further travel services are owed.
(4) Deviating terms of the Tenant do not become part of the contract unless the Landlord expressly agrees to them in text form.
(5) The house rules form part of this contract. They are made available to the Tenant on the website before the booking request is submitted and are sent again with the booking confirmation.
Conclusion of the contract
(1) The presentation of the house on the website and on booking portals does not constitute a binding offer.
(2) By submitting a booking request, the Tenant makes a binding offer to conclude a rental contract.
(3) The contract is concluded when the Landlord confirms the booking in text form (e-mail is sufficient). The date of this booking confirmation is the sole reference point for all periods stated in these terms.
(4) The Tenant is also responsible for the contractual obligations of fellow travellers, provided the Tenant has assumed this responsibility by express and separate declaration.
Prices and additional costs
(1) The total price stated in the booking confirmation is an all-inclusive price. It covers all mandatory additional costs (including final cleaning, bed linen, electricity, water and heating), the tourism levy of the municipality of Lühe, and statutory VAT at the applicable rate. No further mandatory costs arise.
(2) The tourism levy of the municipality of Lühe is included in the total price and is remitted by the Landlord. No separate payment on site is required.
(3) Optional additional services are only charged if they have been expressly booked.
Payment
(1) A deposit of 20 % of the total price is due within seven days of receipt of the booking confirmation.
(2) The balance is due no later than 30 days before the day of arrival, without further request. For bookings made less than 30 days before arrival, the full total price is due immediately.
(3) If the Tenant is in default with a payment, the Landlord may set a reasonable grace period and, once it has expired without payment, withdraw from the contract. In that case the Landlord is entitled to the claims set out in § 9 of these terms.
Arrival and departure
(1) The property is available from 2:00 pm on the day of arrival and must be vacated by 11:00 am at the latest on the day of departure. Different times may be agreed in text form.
(2) If the Tenant exceeds the departure time by more than one hour without prior agreement, the Landlord may claim liquidated damages amounting to one day's rent for the resulting loss of use and delay in cleaning. The Tenant retains the right to prove that no damage was incurred at all, or that it was substantially lower than the lump sum.
(3) If the Tenant does not arrive by 11:59 pm on the day of arrival and does not notify the Landlord of a later arrival, the Landlord may re-let the property after 24 hours. The Tenant's payment obligation is then governed by § 9.
(4) In the event of late arrival or early departure there is no claim to a pro-rata refund, insofar as the Landlord does not save any expenses and re-letting is not possible.
Occupancy and use
(1) The property may be occupied by a maximum of seven (7) persons. Children and infants count as persons. The number of persons stated during the booking process is binding. Exceeding the permitted occupancy entitles the Landlord to terminate the contract without notice under § 10 and to charge for the additional expense caused by the over-occupancy.
(2) Subletting or transferring the property to third parties free of charge is not permitted.
(3) Events, celebrations and parties are not permitted. Statutory quiet hours must be observed.
(4) Day visitors are permitted to a reasonable extent but must be notified to the Landlord in advance. Visitors may not stay overnight.
No smoking, no pets
(1) Smoking is prohibited throughout the interior of the property.
(2) Pets of any kind may not be brought onto the property.
(3) In the event of a breach of paragraph 1 or 2, the Landlord may claim liquidated damages of € 300 for the necessary special cleaning and removal of odours and allergens. The Tenant retains the right to prove that no damage was incurred at all, or that it was substantially lower than the lump sum.
(4) The lump sum under paragraph 3 serves to simplify settlement. The Landlord is entitled to claim the actual damage incurred instead of the lump sum. If the lump sum is not settled, or if the Tenant exercises the right of proof under paragraph 3, the Landlord will settle on the basis of actual cost. In that case the Landlord will commission a specialist company to carry out the necessary professional odour neutralisation (ozone treatment) and the removal of nicotine and tar residues from walls, ceilings, textiles, upholstered furniture and curtains, and will invoice the Tenant for the costs actually incurred and evidenced. Any payments already made towards the lump sum will be credited.
(5) The Landlord will document any breach in a verifiable manner (in particular by photographs and confirmation from the cleaning company engaged) and will make the evidence available to the Tenant on request.
Tenant's duties and liability for damage
(1) The Tenant undertakes to treat the property, its contents, the building and the grounds with care.
(2) The Tenant is liable under the applicable statutory provisions for all damage to the property, its contents, the building and the grounds caused culpably by the Tenant or by persons present there with the Tenant's consent or at the Tenant's instigation — in particular fellow travellers, visitors and third parties engaged by the Tenant. The Tenant is answerable for the fault of such persons as for the Tenant's own fault (§ 278 BGB).
(3) Where it is established that the cause of the damage originates from the Tenant's sphere of custody and responsibility, it is for the Tenant to set out and, if necessary, prove that the Tenant is not at fault. In all other respects the statutory allocation of the burden of proof remains unaffected.
(4) The Tenant is not liable for deterioration resulting from use in accordance with the contract, i.e. normal wear and tear (§ 538 BGB).
(5) Duty to notify: Damage and defects already present on arrival must be reported to the Landlord without undue delay, and no later than 24 hours after taking occupancy. Damage occurring during the stay must be reported without undue delay. If the Tenant culpably fails to give notice, the Tenant is liable for any consequential loss.
(6) Keys: If a key or access device is lost, the Tenant is liable for the costs actually necessary for replacement, including any replacement of the locking system, provided the Tenant is responsible for the loss.
(7) Insurance recommendation: We strongly recommend taking out — or reviewing — personal liability insurance covering damage to rented property, as well as travel cancellation insurance.
(8) Departure: On the day of departure, personal belongings must be removed, household waste must be placed in the designated containers, crockery must be cleaned and put away, and the dishwasher must be emptied. If the Tenant fails to do so, the Landlord may charge for the additional cleaning and disposal effort required.
Security deposit
(1) The Landlord may require a security deposit of € 500. The method of payment — bank transfer no later than seven days before arrival, or cash lodged on arrival — is specified by the Landlord in the booking confirmation.
(2) The deposit is refunded within 14 days of departure, insofar as it is not required to cover legitimate claims of the Landlord arising from this contract. Any retention must be notified to the Tenant in text form, stating the reasons.
(3) The deposit does not limit the Tenant's liability under § 8.
Cancellation by the Tenant
(1) The Tenant may withdraw from the contract at any time before the start of the rental period. Withdrawal must be declared in text form. The decisive moment is receipt of the declaration by the Landlord.
(2) In the event of withdrawal, the Landlord may claim reasonable compensation for arrangements made and expenses incurred. This compensation is calculated as a lump sum, in each case based on the total price:

(3) In every case, the Tenant retains the right to prove that the Landlord incurred no damage at all, or substantially less damage than the relevant lump sum.
(4) If the Landlord succeeds in re-letting the property for the period concerned, the rent achieved less any agency costs is credited against the compensation. The Landlord is obliged to make reasonable efforts to re-let.
(5) Up to the start of the rental period, the Tenant may request that a third party take their place in the contract. Notification must be given in text form. The Landlord may object to the substitution if the third party does not meet the contractual requirements. If a third party enters the contract, that party and the Tenant are jointly and severally liable for the rent and for any additional costs arising from the substitution.
(6) Overpaid amounts are refunded without undue delay.
Withdrawal and termination by the Landlord
(1) The Landlord may withdraw from the contract before the start of the rental period, or terminate the contract without notice during the rental period, if
a) the Tenant is in default with a payment despite a reminder and a reasonable grace period,
b) the property is occupied significantly beyond the agreed number of persons,
c) the Tenant or fellow travellers persistently breach the house rules, the no-smoking or no-pets rule, or quiet hours, despite a warning,
d) the property becomes unusable due to an unforeseeable event (e.g. water damage, fire, official order).
(2) In the case of paragraph 1 (d), the Landlord refunds amounts already paid on a pro-rata basis. The Landlord will endeavour to find equivalent alternative accommodation but is not obliged to provide it. Further claims by the Tenant are excluded, unless § 12 provides otherwise.
(3) In the cases of paragraph 1 (a) to (c), the Landlord retains the claim to the rent; saved expenses and income from re-letting are credited.
Defects, remedy, Tenant's obligations
(1) The Tenant must report any defects without undue delay and allow the Landlord a reasonable period to remedy them.
(2) Within reason, the Tenant is obliged to contribute to remedying a disruption and to keep any resulting damage to a minimum (duty to mitigate loss, § 254 BGB).
(3) If the Tenant culpably fails to give notice, no reduction of rent arises insofar as the Landlord was unable to provide a remedy as a result of that failure (§ 536c (2) BGB). The Tenant's statutory warranty rights otherwise remain unaffected.
Liability of the Landlord
(1) The Landlord is liable without limitation for damage arising from injury to life, body or health based on an intentional or negligent breach of duty by the Landlord, the Landlord's legal representatives or vicarious agents, and for other damage based on an intentional or grossly negligent breach of duty.
(2) In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the foreseeable damage typical of this type of contract at the time the contract was concluded. Material contractual obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the Tenant may regularly rely.
(3) In all other respects, the Landlord's liability for slight negligence is excluded.
(4) The Landlord's strict liability for defects existing at the time the contract was concluded, under § 536a (1) first alternative BGB, is excluded.
(5) The Landlord is not liable for items and valuables brought onto the property by the Tenant, unless the Landlord is guilty of intent or negligence. This is a holiday house without hotel-type services; liability as an innkeeper under §§ 701 et seq. BGB does not apply.
(6) The Landlord is not liable for force majeure, power and water outages of the kind customary in the region, storms, official orders, or impairments caused by unforeseeable building works or by natural and local conditions in the surrounding area. The Landlord will assist in resolving such issues as far as possible.
(7) Travel to and from the property is undertaken at the Tenant's own responsibility.
(8) The above limitations of liability also apply for the benefit of the Landlord's legal representatives and vicarious agents. Claims under the German Product Liability Act remain unaffected.
No right of withdrawal
For contracts on the provision of accommodation for purposes other than residential purposes, for a specified date or period, there is no statutory right of withdrawal under § 312g (2) no. 9 BGB. The cancellation terms in § 9 of these conditions apply instead.
Data protection
Personal data is processed exclusively in accordance with the GDPR and our privacy policy. No consent from the Tenant is required for the data processing necessary to perform the contract; the legal basis is Art. 6 (1) (b) GDPR.
Final provisions
(1) The house rules, the property description and the booking confirmation form part of the contract.
(2) Photographs and texts on the website serve to describe the property realistically. The Landlord reserves the right to change the furnishings, provided the replacements are equivalent and do not impair the purpose of the contract.
(3) The law of the Federal Republic of Germany applies.
(4) Should individual provisions of these terms be or become invalid, the validity of the remaining provisions is unaffected. The invalid provision is replaced by the applicable statutory provisions.
(5) Amendments and additions to this contract, as well as special requests and side agreements, require text form.
(6) The contract language is German. These conditions are drafted in German; translations serve solely to aid understanding. In the event of substantive discrepancies, the German version prevails, except where mandatory consumer protection provisions provide otherwise.
